B-BBEE Affidavit

What is a B-BBEE affidavit?

A B-BBEE affidavit is a sworn statement confirming your business’s Black Economic Empowerment (B-BBEE) level. It’s a simplified alternative to a full B-BBEE certificate, specifically designed for small businesses. If your company qualifies as an Exempt Micro Enterprise (EME) or a 51%+ Black-owned Qualifying Small Enterprise (QSE), you can use an affidavit to prove your B-BBEE status instead of going through formal verification.

This document is legally recognised and widely accepted by government and private institutions for tenders, contracts, and procurement.

Who qualifies to use a B-BBEE affidavit?

You can use a B-BBEE affidavit if:

  • Your business has an annual turnover of less than R10 million (EME); or
  • Your turnover is between R10 million and R50 million, and the business is at least 51% Black-owned (QSE)

If your business doesn’t meet these requirements, you’ll need to go through a full B-BBEE verification process and obtain a formal certificate from a SANAS-accredited agency.

What are the requirements for a valid B-BBEE affidavit?

For your affidavit to be valid:

  • It must be signed by a director or owner of the business
  • It must be signed in the presence of a Commissioner of Oaths
  • It must clearly state your turnover and percentage of Black ownership
  • It must include your company registration number and details
